As per the legislation, the case should be lodged “within 3 months from the date of the incident”. However, the Internal Committee has the authority to “extend the time limit” if “it is satisfied that the woman was unable to file a complaint within the said period”.

The Internal Committee may either refer the victim’s complaint to the police or initiate an investigation that must be completed within 90 days. The Internal Committee can exercise jurisdiction similar to a civil court in India with regards to calling and interrogating someone as per the POSH Act and requesting the exploration of documentation.

Formats of complaint formats are available online in these locations:

It is also advisable that you spend some time researching the Legal Framework, and read up on POSH Act. You should follow any workplace notified rules or procedures pertaining to this subject. In case you require Legal Guidance, you can create a request on our website and someone will get back with a response to your specific query.

If you are not comfortable addressing the issue with the Internal or External Committee, filing an official complaint with the relevant authorities is like the Ministry of Women and Child (http://shebox.nic.in/ ) or the State Women Commission.
